These terms govern your use of Attune, a benchmarking-compliance service operated by Kynth Studio. By purchasing the service, you agree to them.

1. What Attune Does

We file your building's overdue Local Law 84 energy benchmark through ENERGY STAR Portfolio Manager, with your Con Edison usage data, to clear your open NYC benchmarking violation. With the annual plan, we re-file it before every May 1 deadline so it doesn't recur.

2. Fees & Billing

Cure — $499, one time: filing your overdue report and clearing the current violation.

Stay compliant — $199 per year: automatic annual benchmarking so the violation never returns.

Payments are processed by Stripe. The annual plan renews automatically each year until you cancel; you can cancel anytime by emailing us before your renewal date.

3. Your Authorization

By purchasing, you authorize Attune to act as your agent to create and manage your ENERGY STAR Portfolio Manager property, submit your benchmarking report, and request your building's energy data from Con Edison on your behalf. You confirm you are the owner or an authorized representative of the building you submit.

4. Your Responsibilities

Provide accurate building information, including a valid Con Edison account number. Pay any penalty owed to the City directly through DOB NOW — Attune files your report, but the accrued penalty is paid by you to the city, and we never handle that payment. We provide a step-by-step guide.

5. What We Can & Can't Promise

We file your benchmark accurately and on time based on the information you provide, and we watch the public record for the violation to clear. We cannot control the City's or Con Edison's processing times, and clearing a violation also requires you to pay any accrued penalty. We don't provide legal advice.

6. Refunds & Cancellation

If we're unable to file your benchmark for a reason within our control, we'll refund your cure fee. Annual renewals can be cancelled anytime and take effect at the end of the paid year; we don't prorate partial years.

7. Limitation of Liability

To the fullest extent permitted by law, our total liability for any claim relating to the service is limited to the fees you paid us in the prior twelve months. We are not liable for indirect or consequential damages, or for penalties that accrue due to information you provided or actions only you can take.

8. Governing Law

These terms are governed by the laws of the State of New York. We may update them from time to time; any updates will be published on this page with a revised effective date, and continued use after a change means you accept the updated terms. Questions? Contact us at hello@kynth.studio.
